Employment Review: August 2017

This month we consider a number of significant cases concerning (i) the unlawfulness of employment tribunal fees, (ii) voluntary overtime and holiday pay, (iii) unfavourable treatment for the purposes of discrimination arising from disability, (iv) the public interest test for whistleblowing claims, (v) the importance of correctly identifying the employer in the ACAS notification form and claim form and, (vi) injury to feelings awards in the context of discrimination claims.

We also report on the recent judicial consultation to increase bands for damages for injury to feelings and psychiatric injury.
