Jennie is a Senior Associate Solicitor in Freeths’ Construction team and specialises in all aspects of construction law, with particular expertise in advising on disputed accounts on standard and bespoke construction contracts. She has a wealth of experience in acting for both claimants and defendants on a large number of construction disputes and is experienced in resolving disputes through arbitration, mediation and adjudication – and has been involved in a number of reported cases.

Jennie is also experienced in advising clients on transactional construction matters and regularly advises on and drafts both bespoke and standard forms of construction contracts and associated documents. Her clients include local authorities, banks, developers, contractors, architects, engineers and insurers. Jennie is a member of the Chartered Institute of Arbitrators (NW branch) committee and sits on the Education Sub-Committee. She provides training and workshops to industry professionals and regularly presents on recent updates in construction law.

Construction & Engineering Disputes

Cases

  • Acts for the main contractor in a number of adjudications and high profile reported cases concerning the demolition of the coal-fired power station and the design and construction of a circa £125 million new combined cycle gas turbine power station in Trafford.
  • Acted for the Board of Trustees of National Museums and Galleries on Merseyside in a claim against AEW Architects in respect of the defective design of the new Museum of Liverpool.
  • Acted for a large public sector client in relation to its circa £55 million final account dispute with the main contractor.
  • Acts for the sub-contractor in relation to a dispute with the main contractor concerning delays to the completion of the design and construction of a cryogenic storage plant.
  • The Board of Trustees of National Museums and Galleries on Merseyside v AEW Architects and Designers Limited & PIHL UK Limited and Galliford Try Construction Limited (trading together in partnership as a joint venture “PIHL GALLIFORD TRY JV”) (Third Party) [2013] EWHC 3025 (TCC).

Construction

Cases

  • Acted for Manchester City Council in advising on heavily negotiated NEC3 contracts for major leisure and sporting facilities in East Manchester. This included drafting the construction documentation for the new circa £12 million Belle View Sports Village consisting of the new National Speedway track, two new 3g Sports pitches, a National Basketball Centre and refurbishment of an existing Leisure Centre. Jennie also advised the council in relation to the circa £18 million Manchester Institute of Health and Performance (“MIHP”) party funded by Manchester City Football Club. The MIHP focuses on delivering improved public health in the surrounding area and is home to top medical professionals, sports injury specialists and therapists for elite athletes. This work involved due diligence of complex funding documents and ancillary property documentation to ensure that that key obligations were stepped down into the construction documents thus reducing the client’s exposure to risk.
  • Acting for the Royal United Services Institute for Defence and Security Studies advising on circa £5 million refurbishment of their offices at Whitehall. Tasks include assisting the project manager in co-ordinating complex matters regarding neighboring government buildings including the Ministry of Defence, the Cabinet Office and the Banqueting Hall and drafting and negotiating the construction documentation in respect of the project.
  • Acts for large national developers advising on and drafting the construction documents in respect of its portfolio of residential and commercial developments.
  • Acted for Tarmac in advising on NEC3 contract for major highways works in London.
  • Acted for a large oil refinery client in their preparation of a £500 million bespoke framework agreement and associated documents for complex engineering works, then advised on and preparing a suite of JCT construction documentation in relation to the design and construction of a Biodiesel plant. She also advised on the procurement strategy and preparing the construction documentation in relation to the design and construction of a nitrogen facility.
  • Acting for Cape Plc in advising on heavily negotiated NEC3 in respect of civil and structural works on Hinkley Point C.
  • Acting for a prefabricated kitchen and bathroom pod manufacturer client advising in respect of its UK projects including the £2.5 billion development of Canary Wharf’s new district (formerly Wood Wharf) – a residential, mixed use waterside community as well as the £120 million development of the Camden Lock waterside development in London.
  • Acted for a national pub retailer and brewer client advising on the construction aspects on a large portfolio of acquisitions.
  • Acted for a food processing industry sector client in respect of a £6 million refurbishment contract.

Jennie has a vast amount of experience within the Energy, Infrastructure and Natural Resources sector. She has represented a number of high profile clients on their projects in the UK and internationally in both contentious and transactional matters.

  • Jennie acts for Cape Plc in advising on a heavily negotiated NEC3 in respect of civil and structural works on the new nuclear power station at Hinkley Point C.
  • She also acts for Duro Felguera in respect of their works as main EPC contractor on Carrington Power Station in Manchester.
  • Jennie acted for ESSAR Oil in respect of advising on and drafting a bespoke £500 million framework agreement and associated documentation for complex engineering works at their oil refinery site in the North West. She also prepared a suite of JCT construction documentation in relation to the design and construction of a Biodiesel plant, as well as advising on the procurement strategy and preparing the construction documentation in respect of the design and construction a nitrogen facility.

Local Government

Jennie regularly acts for public sector clients and understands the approach required when acting for local government. She is able to guide her clients, many of which are not experienced property developers, through the construction process and provide invaluable advice and assistance at every stage. Jennie understands the requirements for reporting and auditing within the public sector and is regarded as an extension of the in-house team.
