Martyn undertakes advisory work for banks, financial institutions, companies and directors on all issues arising out of restructuring distressed businesses. He has been retained by many boards of directors to advise them on their duties in a range of complex assignments.
His practice includes initial contingency planning through to implementation and management of restructurings dealing with multiple stakeholders.
Martyn also acts for UK and international insolvency practitioners in relation to contentious restructuring and insolvency law assignments often involving cross-border investigation and asset tracing work. He advises stakeholders on the recovery of dissipated assets throughout the world and has experience of the investigatory powers of international insolvency processes.
Martyn has a particular specialism in the distressed financial services sector having recently acted on the special administration of an investment bank and the liquidation of a company that provided access to a financial markets trading platform.
Insolvency & Corporate Recovery
- Acted for the special administrators of Hume Capital Securities Limited in successfully returning circa £40 million in value of client assets and circa £6 million in client monies to customers. This involved the submission of a Distribution Plan which was approved by the Court (the first since MF Global). The Judgment, which was widely reported, stated: “The plan was a highly convenient method of achieving the objective of returning client assets. It was fair, equitable and reasonable in all the circumstances. Any alternative was likely to impose unnecessary delay and cost.”
- Acted for Park Capital and UMC Group on the purchase of HPI Racing Group, a global manufacturer and distributor of radio-controlled hobby vehicles, in a complex acquisition and turnaround. This involved a UK-based distribution operation, a manufacturing business in China, and a US-based distribution and design business.
- Acted for the directors of a large construction company operating in various states in the Middle East in relation to the restructuring of its loan facility (circa £110 million) with a Bahraini bank.
- Acted for a Trustee in Bankruptcy in the successful recovery of circa £7 million for the bankruptcy estate.
