Tricia specialises in financial management for clients under a physical or mental disability, including those who have received damages awards. When one of the partners has been appointed by the Court of Protection as a deputy or a personal injury trustee, she manages the matters on a day-to-day basis.
She is very experienced at dealing with difficult situations, where the client has no family or has been left in dire circumstances because of financial mismanagement. Tricia also prepares applications to register Enduring Powers of Attorney and Lasting Powers of Attorney, and advises on a range of elderly client matters.
Court of Protection & Deputyships
Tricia prepares application to the Court of Protection for appointment of deputies, where a person has lost capacity and is no longer able to make decisions regarding their property and financial affairs.
She also provides in lay deputy and trustee support. This may be where there is an attorney appointed, but lives too far away from the donor and Freeths are instructed to help with general matters.
- Recently making an application to the Court of Protection for authority for attorneys appointed under an Enduring Power of Attorney to manage their relative’s portfolio. The Enduring Power of Attorney did not have a discretionary investment clause included at the time of registration.
- Tricia recently drafted a complaint to the Department for Work and Pensions in relation to the non-payment of a benefit for her client. She felt that the benefit should have been backdated over some years and that the client had been financially penalised for not having the capacity to deal with the claim themselves. The claim was successful.
