Notable work & expertise
- Acting for a leading manufacturer of high-performance vehicle braking systems in enforcing a non-compete restriction to prevent a key R&D employee joining a competitor in breach of that restriction. We supported our client in undertaking an internal investigation, which identified that the employee had taken highly sensitive and confidential documents belonging to our client, and obtained an injunction which prevented the employee from joining the competitor until the restriction expired. We were also able to secure a settlement under which the employee paid a substantial portion of our client’s legal costs
- Advising a leading vehicle windscreen specialist in a dispute arising from the alleged use of a confidential customer list by a new joiner
- Representing one of the UK’s largest funeral service providers to enforce restrictions preventing a former business owner and his colleague from joining a competitor after our client acquired their business
- Advising a skincare and aesthetics company in a cross-border dispute with a consultant based in the United Arab Emirates who had entered into a secret commission agreement with a third-party
- Acting on behalf of seven Defendants in a claim worth around £25 million. Our clients were accused of fraud and of breaching various warranties that they gave to the Buyer on the sale of their specialist IT business. We were successful in striking out the Claimant’s allegations of fraud at an early stage of the claim
- Advising an international packaging company in a claim worth around £5 million. The claim was against two former Directors and Shareholders, who had sold their business to our client and were accused of fraudulently concealing a transaction that took place before the sale, which had artificially increased the price that our client had paid for the business
- Acting in a multi-million pound professional negligence claim against a firm of chartered surveyors, arising from the valuation of a holiday park
- Representing an individual in relation to the negligent drafting of a Share Purchase Agreement and Legal Charge by their former solicitors
- Advising on a claim against a well-known firm of solicitors arising from a limitation date for a claim being missed
- Representing a specialist manufacturer of niche products in a multi-layered dispute with a supplier regarding the ownership of machinery and orders placed by a key customer
- Providing urgent advice to a national waste management company in relation to an injunction that had been threatened by a customer relating to the alleged non-disposal of waste
- Acting for an international hotel provider in defending an injunction brought against them by a supplier
- Advising a shareholder on an unfair prejudice claim arising from the failure by the company’s directors to consider paying dividends to the shareholders
- Representing a London-based business turnaround specialist in the management of risk associated with a complex share restructure
