Tax implications for natural capital projects

This seminar will be delivered by Freeths tax partner Adrian Hackett together with Calum Kamara. They will consider the tax implications of natural capital projects on (i) landowners, (ii) intermediaries, (iii) investors, and (iv) developers, including:
- natural capital projects being in the nature of a trade carried out by the landowner or an intermediary;
- whether landowners are disposing of an interest in the land when giving up their land to a natural capital project;
- the receipt of and accounting principles applicable to lump sum payments such as those received on entering into the obligation to deliver the natural capital project;
- the disposal of land subject to obligations which run with the land under conservation covenants or s.106 TCPA 1990 agreements;
- ring-fencing lump sum payments for draw down over time to fulfil habitat bank management and maintenance obligations under which nature credits are granted;
- the use of company and partnership vehicles to bring investment into nature capital projects;
- the nature of returns made to investors in nature capital projects;
- VAT on the sale of nature capital units
