International construction markets continue to face increased uncertainty through 2026. For those working on energy, infrastructure and construction projects around the world, the ability to successfully manage risks arising from unexpected events and the pressure placed on supply chains, while protecting rights to claim time and money where available, is key.
Drawing on examples from our international construction disputes practice, and contrasting common law and civil law approaches under English and German law (and how the same clause may have potentially different consequences depending on the jurisdiction), we will discuss key FIDIC provisions addressing force majeure and time and money claims.
