Notable work & expertise
- Jessica recently acted for FFS (2023) Limited in a claim against the administrator of the estate of a deceased director arising out of breaches of the deceased director’s fiduciary duties. The administrator of the estate made a Part 8 claim seeking Beddoe relief and approval under section 284 of the Insolvency Act 1986 concerning the administration of the claim and, in particular, the conduct of proceedings brought by FFS (2023) Limited against the estate
- The matter came before Master Marsh (sitting in retirement) who determined that the correct test for the purposes of section 284 of the Insolvency Act 1986 “involves a consideration of interests of both the creditors and the beneficiaries” and was satisfied that “the limited approval granted balances their respective interests”
- The scope of the approval given by the Court was very limited and did not extend, as had been sought in the administrator of the estate’s application, to work preparing for and attending the Costs and Case Management Conference
- The judgment was reported in the All England Law Reports: Wedgwood (as administrator of the estate of Aleem Hosein deceased) v Hosein and another company [2024] EWHC 1836 (Ch)
