Jill Carey

Jill’s experience encompasses a broad spectrum of commercial and residential Real Estate Disputes work. This includes: vacant possession strategies; opposed and non-opposed lease renewal claims; disputes relating to restrictive covenants and easements; fire safety matters; rent reviews; breaches of covenants and forfeiture; landlord’s consents; dilapidations claims; claims under development agreements; advice on overage and other land contracts; boundary disputes; and nuisance and trespass claims.

She works with a number of other teams on complex property matters with multiple elements to them, including our Planning; Competition; Insolvency; Environmental; Construction; Public Law; and Regulatory teams.

Jill has expertise in acting for both landlords and tenants as well as parties such as insurers or neighbour disputes. In particular she has acted for some very different clients, ranging from large international companies and trusts to ultra high net worth individuals and charities.

Recent work

• Advising a large retailer on the application and potential release of restrictive covenants that might prevent the use of the target site for the client’s purpose – for example restrictions on food retail or the sale of alcoholic beverages, or a covenant not to cause nuisance

• Acting for the owners of several large town centre shopping malls on the recovery of vacant possession from multiple tenants to facilitate redevelopment

• Advising on the scope of a right of way and whether it would be sufficient for redevelopment of a site into a supermarket

• Advising the interim landlord of a multi-let warehouse on a substantial dilapidations claim and recovering sums from subtenants

• Acting for a large retailer on working with the landlord to secure vacant possession using grounds (f) and (g) of Section 30 Landlord and Tenant Act 1954

• Seeking possession where tenants were in substantial arrears

• Advising on obtaining vacant possession where trespassers have entered development sites

• Acting for tenants and estate occupiers where the landlord has failed to carry out suitable and sufficient works to common parts and car parks

• Dealing with numerous breaches of alienation and alterations covenants

• Acting for the landlord of one of London’s landmark buildings on a vacant possession strategy for the iconic top floors as well as numerous other issues with other floors let to office occupiers

• Advising the owner of a large site on encroachment by adjoining owners and claims for adverse possession
