Health Secretary, Wes Streeting, has today announced a national investigation into the 10 "worst performing" maternity services in England, sparking significant attention and hope for much-needed reforms.

The investigation comes on the heels of several high-profile maternity scandals that have rocked the NHS in recent years. Freeths have worked closely with patients and families who are part of the Nottingham maternity inquiry, now the largest single inquiry in the history of the NHS, looking at cases which have exposed severe deficiencies in maternity care. Common issues include failures in compassionate care, safety concerns, and problematic leadership and cultural practices.

Families of the Nottingham maternity inquiry met last week with the Health Secretary to discuss progress so far. Following the same, the families have said that they felt they were listened to but have stressed that this is not the end and they "would not be going anywhere" without the confirmation of a full statutory public inquiry. The Health Secretary has confirmed that the meeting was helpful in informing his plans moving forward.

The new national investigation will be spearheaded by NHS England's chief executive and chief nursing officer, under the legal framework provided by the Health and Social Care Act 2012 and the NHS Constitution. These laws mandate the provision of safe and effective care and enshrine patients' rights to high-quality care.

The investigation represents a pivotal opportunity to address long-standing issues within NHS maternity services.

Jane Williams, Head of Clinical Negligence for the East Midlands and North East at Freeths LLP has stated: “The announcement of a national investigation is not only a much needed development, but long overdue. It is time once and for all to learn from mistakes, implement recommendations from previous inquiries and reviews and improve patient safety.”

As clinical negligence lawyers, we represent many families and children affected by failures in maternity care during labour and birth, including those who have lost loved ones. We have seen the number of enquiries increasing, and we welcome anyone with concerns to approach us to discuss how we might be able to help.

Our goal is to ensure that children who have suffered preventable injuries receive the necessary services, such as care, therapy, aids, equipment, and appropriately adapted accommodation to support them throughout their lives. For families who have experienced loss, we provide support and therapy to help them cope with these tragic events. Additionally, we strive to secure an apology from the responsible Trust and work to prevent similar mistakes in the future.
