Mr B - Preventing Get refusal in financial negotiations

Mr B and his wife were divorcing following a short marriage, where there were limited financial claims. The main issue was surrounding the Get. Mr B was concerned that Mrs B’s family’s involvement in financial negotiations meant that Mrs B would refuse to accept the Get (Jewish divorce). Mr B was also concerned that Mrs B was from an influential family and would be able to use the Get for financial advantage or to stop him moving forward with a new relationship.

We ensured that the financial order submitted to court dealt with each party’s obligation to comply with the Get process. Following the judge sealing the court order, but before the civil divorce was complete, the parties attended the Beth Din and completed the Get process.

Ms L - Ensuring Get completion before divorce finalisation

The parties had been separated for many years before starting divorce proceedings. They were both Orthodox Jews and the husband had a new partner. We represented the wife. There was a lot of mistrust between the parties and concern that the Get would be used as a bargaining chip.

We applied to court to ensure that the marriage could not end until the Get had been properly given and received. The parties reached an outline financial agreement, which included cooperation over the Get process. The husband first attended the London Beth Din to give the Get. The wife later attended the Beth Din separately, and our family team attended with for support when she received her Get. Following the Beth Din appointment, we confirmed to the court that the Get process was complete. Upon the financial order being sealed, the final order of divorce was made.
