User Generated Content
All websites that have links to the UK that allow users to generate content (usually referred to as “User Generated Content” or “UGC”), are subject to the provisions of the Online Safety Act 2023.
These websites are required to publish specific information in their terms of service in clear and accessible terms, in addition to required information for your website.
This includes:
- Details on how the service provider will protect individuals from illegal content, including their systems and processes for content removal
- Providing clear and accessible information about any proactive technology used for content protection
- Specifying the policies and processes governing the handling and resolution of different types of complaints
- Informing users about their right to address a breach of contract where regulated user-generated content is removed, access is restricted, or the user is banned from the platform
- Details on how the service provider will prevent children of all ages from encountering harmful content and the measures taken to protect children where full prevention is not possible
- Providing clear and accessible information about any proactive technology used to protect children from harmful content
